TERMS AND CONDITIONS ,,MY SPOT"

  • MY SPOT LOYALTY PROGRAMME TERMS AND CONDITIONS

MY SPOT LOYALTY PROGRAMME TERMS AND CONDITIONS

The SPOT mobile application (the “App”) is owned by NE Property B.V. (the “Company”), which has the right to use it within Bonarka City Center Sp. z o.o. (the “Shopping Centre”), as part of the NEPI Rockcastle Group, with its registered office in Warsaw at ul. Twarda 4, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, under KRS number 0000510842, Tax Identification Number (NIP): 5252587390, Statistical Identification Number (REGON): 147254436.

The SPOT mobile application consists of software accessible on both iOS and Android operating systems. It is available free of charge from the App Store and Google Play and provides Users with a range of services, as well as loyalty points that entitle Users to rewards and discounts on products and services offered at the Shopping Centre.

The purpose of these Terms and Conditions is to provide Users, as defined in the Terms of Use, with complete and accurate information regarding the terms and conditions governing the My SPOT loyalty programme (the “Loyalty Programme”).

By downloading the App and registering for the My SPOT loyalty programme, the User accepts and agrees to comply with these Loyalty Programme Terms and Conditions.

To use the App, the User must install it on a mobile phone or tablet running iOS or Android. The mobile application may only be used after the User has accepted the currently applicable Terms of Use.

The benefits offered are updated periodically in the App. The Shopping Centre reserves the right to amend the Terms of Use, the Privacy Policy, and/or these My SPOT Loyalty Programme Terms and Conditions at any time.

    1. MY SPOT LOYALTY PROGRAMME

    1.1. General Information

These Terms and Conditions describe the My SPOT loyalty programme. The programme details provide comprehensive information about the programme, including its latest updates. Programme details may change periodically; therefore, Users are encouraged to check them regularly to stay informed of the latest information.

My SPOT is a loyalty programme integrated into the SPOT mobile application.

My SPOT is based on a system of awarding loyalty points for purchases made at stores in shopping centres participating in the programme. The Loyalty Programme has the following structure:

    • Benefits granted based on the status achieved by the User in the App, including discounts and exclusive benefits.

    • The option to redeem loyalty points collected in the App for rewards and services.

    1.2. Eligibility and Registration

The My SPOT programme can be accessed through the “My SPOT” section. To join the Loyalty Programme, Users must register by creating a user account in the App.

    2. LOCATION

The mobile application is available across the portfolio of NEPI Rockcastle shopping centres. A list of shopping centres participating in the My SPOT Loyalty Programme can be found in Appendix 1 to the Terms of Use.

Users can select in the App the main shopping centre they visit most frequently. They may select another shopping centre when visiting other shopping centres in the NEPI Rockcastle portfolio in Poland, whether travelling outside their place of residence or simply visiting another centre.

Users can collect points for purchases at any participating shopping centre. They can also redeem points and enjoy the benefits associated with their status in the App at any shopping centre participating in the programme.

The current Loyalty Programme Terms and Conditions apply to Bonarka Shopping Centre (hereinafter the “Shopping Centre”), located at ul. Kamieńskiego 11, 30-644 Kraków, Poland.

    3. HOW TO COLLECT POINTS

3.1. Users collect points for purchases made at stores in participating Shopping Centres at the rate of PLN 1 = 1 point. Stores listed in Section 3.3 are excluded from this rate. Users can also collect points by performing the following activities in the App:

    • Creating an account in the App (Registration): 100 points.

    • Completing the profile in the “My Account” section: 100 points.

    • Recommending the SPOT app to a friend. Users can send an invitation code to their friends. The User will receive 100 points when the invited friend creates an account in the App using the invitation code. A User may receive a maximum of 500 points per year.

    • For the first voucher scanned by a friend invited to the App, the User receives 100 points. A User may receive a maximum of 500 points.

    • Checking in at the Shopping Centre: 20 points. Users may check in at the Shopping Centre a maximum of twice per week and collect a maximum of 200 points per month.

    • Scanning a receipt from a purchase made at the Shopping Centre: the User receives 1 point for every PLN 1 spent, subject to the following exceptions: 1 point for every PLN 2 spent at a supermarket, hypermarket or other grocery store listed in Section 3.3(i), and 1 point for every PLN 5 spent at electronics stores listed in Section 3.3(ii).

3.2. Participants may choose one of the following methods of collecting points:

    1. Collecting points by manually scanning receipts in the App; or

    1. Collecting points automatically by synchronising a bank account with the account in the App.

A Participant may use only one of the above methods of collecting points at any given time. A Participant may change the point collection method at any time, but no more than once per day.

Collected points cannot be exchanged for cash. Each User may access the benefits available at the membership level they have achieved at a given time.

3.3. Converting purchase receipts into points

For purchases made at the Shopping Centre, Users receive loyalty points by scanning the receipt using the receipt-scanning feature available in the SPOT App.

    a) Standard rate: every PLN 1 spent earns 1 point (PLN 1 = 1 point), subject to standard mathematical rounding rules.

    b) Exceptions:

    (i) Purchases at hypermarkets, supermarkets or grocery stores: every PLN 2 spent earns 1 point (PLN 2 = 1 point), subject to standard mathematical rounding rules.

(ii) Purchases at Media Expert, RTV euro AGD, Samsung, Sony Centre, iSpot and X-KOM: every PLN 5 spent earns 1 point (PLN 5 = 1 point), subject to standard mathematical rounding rules.

(iii) The following purchases and expenses earn 0 points: currency exchange and precious metal exchange; payment intermediary services, including utility bill payments; banking and insurance services; gambling and/or casino games; gift vouchers purchased at the Info Desk; fuel; alcohol; tobacco products; electronic cigarettes; medicines; prepaid cards; telephone network services; travel agency services; advances paid to travel agencies; and transactions at post offices. See the list of excluded stores in Appendix 3.

3.4. The following conditions and restrictions apply to receipt scanning:

    a) Maximum number of receipts scanned per store per day: 2.

    b) Maximum total number of receipts scanned per User: 10 per day and 20 per week.

    c) Maximum number of points that can be earned per month, calculated from the date of the first receipt scan, regardless of the number and value of receipts scanned: 4,500 points.

    d) Minimum accepted value of each scanned receipt: PLN 30.

    e) Minimum accepted value of each receipt when Automatic Point Collection is enabled: PLN 20.

    f) Maximum period for scanning a receipt after it has been issued: 2 days (48 hours from the time the receipt was printed).

    g) Maximum number of rewards a User may redeem: 2 per day.

    h) Employees of a Retailer and their relatives, including spouses, children, descendants and siblings, may participate in the Programme, provided that they do not register receipts issued by the Retailer for whom the employee works.

Users may not lend their collected points to other Users or transfer them from one account to another.

Scans of receipts that are not in the User’s possession, including photographs of receipts belonging to other people, will not be accepted. The User must be the owner of the receipt and the person who paid for the purchase. As the automatic receipt identification system recognises only fiscal receipts, and to prevent fraud, scans other than valid scans of fiscal receipts will not be accepted.

Scans of tax invoices, non-fiscal receipts, and receipts issued for business purchases that contain the purchaser’s Tax Identification Number (NIP) and are equivalent to invoices will not be considered valid for participation in loyalty programmes offered by the Shopping Centre and/or the Company’s Business Partners.

Each receipt may be registered only once and by only one User. The same receipt may not be registered in the Programme by two different Users. Doing so will be considered a breach of these Terms and Conditions.

Points for scanned receipts may be awarded automatically immediately after scanning. If there is any uncertainty regarding the scan, the Shopping Centre and/or the Company’s Business Partners reserve the right to review the receipt within up to 3 business days, after which the appropriate number of points will be awarded to the User.

Once points have been awarded, the App will indicate this by displaying the updated point balance in the relevant section on the User’s mobile phone screen.

The number of points already awarded to a User may not be reduced as a result of such a change.

The Shopping Centre and/or the Company’s Business Partners may modify the rewards available in the “Rewards Catalogue” section of the App at any time, both in terms of the range of rewards and gifts offered and the number of points required for each reward. Users will be notified of such changes within the App.

The Shopping Centre and/or the Company’s Business Partners reserve the right to deduct points obtained by Users through fraudulent activity.

If a User deletes their account or the Company closes the account, any collected and unused points cannot be lent to other Users or transferred to other accounts and will be forfeited. If the Company decides to discontinue the App, Users will be notified 30 days in advance. Any points not redeemed by the date the App is discontinued will be forfeited.

    4. AUTOMATIC POINT COLLECTION

    4.1.

As part of the Loyalty Programme, a Participant may activate Automatic Point Collection as a separate feature of the Loyalty Programme.

    4.2.

The provider of the Automatic Point Collection feature (service) is Spaycial/Transaction Connect, a French company with its registered office at 86 Rue du Faubourg Saint-Denis, 75010 Paris, France, registered with the Paris Trade and Companies Register under number 822 619 185 (“Transaction Connect”).

    4.3.

During registration or at any time after registering for the Programme, a link enabling the activation of Automatic Point Collection will be available in the Participant’s account.

If the User (the “User who has activated the Automatic Point Collection service”) decides to activate Automatic Point Collection, the service will be provided by Transaction Connect. The User provides Transaction Connect with the following information: bank, account type and any other information that may be required by the relevant eligible entity’s branch. The User also consents to the synchronisation of their account with their Loyalty Account in accordance with the terms governing the use of Automatic Point Collection, available at the following link: Terms of Use.

The Participant undertakes to provide accurate and complete information and to update that information as frequently as required.

The Participant must reactivate their payment card in the App every 90 days to ensure that points continue to be collected automatically through this feature. The User will receive reminders to reactivate the card by email and push notifications.

If the User does not reactivate their payment card within 10 days after the 90-day period referred to above, their status will be downgraded from VIP to the level corresponding to the number of points collected.

Details regarding the operation of Automatic Point Collection are set out in the Terms of Use provided by Transaction Connect.

    4.4.

Upon activating Automatic Point Collection, the Participant obtains VIP status.

    4.5.

The Automatic Point Collection feature is available and may be activated only while the Programme is in operation.

    4.6. Definitions

For the purposes of interpreting and regulating Automatic Point Collection, the following terms are defined:

    a) Eligible Entities – banks eligible to participate in the Programme, meaning any company operating in Poland or a company with a permanent registered office in Poland, as listed in Appendix 2 to these Terms and Conditions.

Note: At the discretion of Transaction Connect, the entity responsible for Automatic Point Collection, any company may be removed from the list of Eligible Entities without any right to compensation or reimbursement of costs for the Participant.

    b) Synchronised Account – an account synchronised with the User’s Account. A Synchronised Account may be a bank account.

    c) Payment Method(s) – the payment instrument(s), i.e. payment card(s), linked to the Participant’s Synchronised Account. All Payment Methods linked to the Participant’s Synchronised Account will trigger Automatic Point Collection for eligible purchases. The User is not required to update their details when their Payment Method changes, for example, when they receive a new payment card.

    4.7. Activating Automatic Point Collection

    a) To activate Automatic Point Collection, the Participant:

    • must have an active Account; and

    • must link their bank account to their Account, select the relevant account provider (the bank where the Participant holds an account), and then enter, through a secure interface, the same username and password they use to access the secure interface for checking their bank account. This process is carried out in accordance with the applicable Payment Services Directive PSD2 and results in synchronisation.

Note: The User’s bank, where the User holds the bank account selected for synchronisation, must be included in the list of Eligible Entities.

    b) The User may earn additional points by recommending the App and sharing information available in the App, including information intended exclusively for VIP Users.

    c) Points relating to a Synchronised Account may appear up to 7 days after a purchase made at Bonarka Shopping Centre.

    d) Points for purchases made by a VIP User will be automatically credited to their Account after the purchase is made at a Retailer’s premises within Bonarka Shopping Centre and the transaction is posted to the bank account.

    e) If a VIP Account is not updated within 90 days of the date of synchronisation or the last update, the User will earn points for purchases made at the Shopping Centre only for the period during which the Account remains synchronised.

    f) Joint bank accounts: a single bank account may be synchronised with only one Account. All Payment Methods linked to the joint bank account will trigger point collection in the Account synchronised with that bank account.

    g) Once Automatic Point Collection is activated, payments made from one bank account will not be accepted under another loyalty account.

    h) The same purchase may be registered only once and under only one Account. The same purchase may not be registered in the Programme by two different Participants. Doing so will be considered a breach of these Terms and Conditions.

    5. POINT VALIDITY PERIOD

Points awarded before 21 October 2025 remain valid for 24 months from the date they were awarded. After this period, the points are automatically cancelled, and the User may not make any claims in respect of them.

From 21 October 2025 onwards, all newly awarded points are valid for 6 months from the date they are awarded. After this period, the points are automatically cancelled and cannot be reinstated.

    6. REDEEMING LOYALTY POINTS

Loyalty points collected in the App may be redeemed for selected rewards and benefits available at the Shopping Centre, such as rewards, shopping vouchers and services offered there.

Users can view the list of rewards and redeem their loyalty points for selected rewards in the “My SPOT – Rewards Catalogue” section. The list of rewards is specific to each shopping centre and can be viewed in the relevant section after the User selects their preferred shopping centre.

Users are not entitled to exchange rewards for cash, other products or other benefits.

Users must retain the original paper receipt for a purchase worth at least PLN 150 throughout the current calendar year and for at least 30 business days after the end of that calendar year.

The Organiser also reserves the right to verify receipts registered in the Loyalty Programme, particularly when a User redeems a reward costing 10,000 points or more, based on the initial point value. During the verification process for such rewards, only photographs of original receipts will be accepted. Bank statements, photocopies of receipts and photographs of receipts from the “Points History” section of the App will not be accepted.

    7. POINT HISTORY

Users can view their collected and redeemed points in the “My SPOT – Points History” section.

7.1. Achieving SPOT membership status in the App

Depending on the number of points collected or credited through Automatic Point Collection, Users may achieve one of the following four status levels:

    • BRONZE: assigned by default upon registration in the App.

    • SILVER: achieved upon reaching 5,500 points.

    • GOLD: achieved upon reaching 12,500 points.

    • VIP: assigned to a User who has enabled Automatic Point Collection as a feature of the Loyalty Programme by synchronising their bank account with their payment card in accordance with Section 4 of these Terms and Conditions.

Each of these four levels provides access to exclusive benefits and special discounts at partner stores.

    7.2. Expiry of membership status

When a User achieves a new status in the App, it remains valid for 24 months and is available across all participating NEPI Rockcastle shopping centres in Poland. A list of participating shopping centres can be found in Appendix 1 to the Terms of Use.

The exception is SPOT VIP status, which remains valid for as long as the User’s bank account is synchronised and the User has not changed the point collection method to manual receipt scanning.

If the User does not reactivate their payment card within 10 days after the 90-day period following the last synchronisation, their status will be downgraded from VIP to the level corresponding to the number of points collected.

7.3. Benefits granted to Users according to membership status

Depending on the membership status achieved in the App based on the points collected, Users may access discounts at partner stores and exclusive benefits.

The benefits granted to Users will be listed in the App and updated periodically by the Shopping Centre. They may include discounts at partner stores, VIP benefits, preferential services or invitations to events.

Users can view the benefits available to them according to their status in the “My SPOT → My Benefits” section of the App.

Benefits such as discounts, rewards, event invitations and other experiences cannot be exchanged for cash.

Discounts offered under the SPOT Programme:

    a) Cannot be combined automatically with loyalty cards issued independently by partner stores. Each My SPOT loyalty programme partner store will decide whether its discounts can be combined with other offers or discounts provided by that store. The conditions for accessing discounts will be specified in the “Discounts” section.

    b) Can be redeemed by scanning the barcode generated in the “Discounts” section under the relevant partner store’s offer, or by presenting the discount in the App at the checkout of the store where the User wishes to redeem it.

7.4. How to redeem offers and rewards

    7.4.1. How to collect rewards

To collect rewards redeemed in exchange for loyalty points, the User must follow these steps:

    (i) The User selects their preferred reward in the “Rewards Catalogue” section of My SPOT.

(ii) If the User has sufficient points to redeem the reward (product or service), they select the reward and click “Redeem Now”.

(iii) The selected reward will be reserved for the User.

(iv) The User will receive a confirmation email containing information on how to collect the reward: the name and description of the selected reward, the reservation date, the collection location and the collection deadline. The email may also include a QR code or the date and time of an event.

    (v) The User must collect the reward by the deadline specified in the reservation confirmation email. The standard collection period is 1–3 business days from the date of reservation, unless the rules of a specific campaign provide otherwise. Rewards may only be collected during the opening hours of the Info Point or Administration Office at the relevant Shopping Centre. Users should take the collection point’s opening hours into account when making a reservation.

Once the collection deadline has passed, the reward reservation expires. Points deducted for redeeming the reward may be manually returned to the User’s account only in exceptional, justified circumstances. A request for a refund of points must be sent to supportpl@myspot.space within 7 days of the reservation expiry date. After this period, the points are permanently forfeited and cannot be refunded.

The employee handing over a reward selected by the User or granting access to an exclusive event will ask the User to scan the QR code in the App. Once the code has been validated, the employee will hand over the reward or grant access to the event.

The Company and/or the Shopping Centres are not responsible for how Business Partners offer, deliver or hand over rewards.

After collection, all rewards can be viewed in the “Points History” section.

Participation in loyalty programmes to obtain rewards does not involve any additional fees or expenses for Users.

Rewards offered under the My SPOT Loyalty Programme and benefits granted based on membership status, such as access to discounts, are available concurrently. The User decides whether to use both types of benefits within the Loyalty Programme.

7.4.2. Warranty and complaints concerning rewards

The Programme Operator does not provide a warranty for rewards issued under the Programme. If a product is covered by a warranty, that warranty applies in accordance with the terms and duration specified by the relevant store, tenant or manufacturer.

If a problem occurs with a product, the Participant should report it to supportpl@myspot.space, providing details that allow the reward to be identified and describing the problem.

Complaints submitted through the Operator are accepted only for rewards in the Electronics category and only during the applicable product warranty period.

If a complaint is accepted, the only available remedies are replacement of the product with a new item or refund of the points used to redeem it. The Participant is not entitled to a monetary refund or cash payment.

7.4.3. How to redeem discounts at partner stores

To redeem a discount, the User must visit the relevant Business Partner directly, i.e. the store in the Shopping Centre to which the offer applies. Before paying for the products, the User must present the store’s discount offer in the App or the barcode provided as part of that offer. The barcode will be scanned by a store employee.

The discount will be applied directly at the checkout. The Company and/or the Shopping Centres are not responsible for how a Business Partner offers or grants a discount.

Participation in loyalty programmes to obtain benefits does not involve any additional fees or expenses for Users.

    8. CANCELLATION OF POINTS AND ACCOUNT BLOCKING

    a) The Shopping Centre and/or the Company’s Business Partners reserve the right to deduct points obtained by Users through fraudulent activity, for example by scanning copies of receipts; scanning receipts for purchases not made as a customer of the Shopping Centre; scanning receipts from a store where the User works; or scanning receipts and subsequently returning the goods without informing the Organiser that the return has taken place and without reporting the cancellation of the receipt, etc.

If, after the deduction of points, the remaining balance in the Programme is insufficient to redeem a reward, the Participant loses the right to that reward. If the reward has already been handed over to the Participant, the Participant must return the reward or its equivalent value, at the Organiser’s discretion.

    b) If a User scans a receipt displayed on the screen of another device; a photograph of a receipt; a receipt that has been altered in any way and/or superimposed on another receipt; a receipt proven not to belong to that User; or fails to comply with the maximum limit of 2 receipts per day (the previous 24 hours) and 20 receipts per week (the previous 7 days), as specified in Section 3.4, or if the User is an employee of a tenant at the Shopping Centre and scans receipts from the store where they work, the owner of the App and/or the Company may block the User’s access to the App.

    9. WITHDRAWAL AND AMENDMENTS

The Company may withdraw or amend the My SPOT Loyalty Programme at any time it considers appropriate, change or cancel the list of benefits and rewards available in the App, and change the stores participating in the Programme, without prior notice to or consent from the User.

    10. INFORMATION AND COMPLAINTS

Users may send any questions, comments or complaints to supportpl@myspot.space.

All complaints or enquiries relating to the operation of the Loyalty Programme will be resolved by the Shopping Centre within 30 days. The complaints procedure does not affect any rights or remedies available to consumers under applicable law.

    11. OTHER INFORMATION AND TERMS OF USE

A User may create only one user account and must provide accurate information. To verify the identity of a User applying for benefits under their account, the Shopping Centre may ask the User to present an identity document, such as an identity card, driving licence or passport.

The account is personal, and Users are prohibited from sharing their login credentials with other people.

The Shopping Centre reserves the right to delete an account or cancel collected points in the following cases where a User breaches any of the rules set out in the Terms of Use, including:

    a) where points have been collected through fraudulent activity;

    b) where points have not been redeemed within 24 months of being awarded.

Users may reset their password by following the instructions provided in the App.

Users are required to check periodically for changes to the Terms of Use and the Privacy Policy.

If a User does not wish to accept the Terms of Use and the Privacy Policy, including any amendments and/or additions to them, the User must stop using the App.

    12. PERSONAL DATA PROTECTION

The general legal framework governing the protection of personal data is established by Regulation (EU) 2016/679, the General Data Protection Regulation (“GDPR”), applicable within the European Union.

Details of the categories of personal data processed in connection with the use of the App, together with information about the related processing activities, are available in the Privacy Policy.
